Your Phase Ltd. Terms and Conditions of Service

1. Introduction
1.1 These Terms and Conditions of Service ("Terms") govern the use of the Phase Apps, the Phase Browser Extensions, Third Party Integrations, and the websites accessible at https://www.phaseapp.io/ and https://my.phaseapp.io/ (together, the "Services") provided by Your Phase Ltd., a private limited company registered in England and Wales under company number 15278185, with registered office at Kings House Work.Life, 174 Hammersmith Road, London, England, W6 7JP ("we", "us", or "our").
1.2 By accessing or using any part of the Services, you agree to be legally bound by these Terms. If you do not accept these Terms, you must not use the Services.
1.3 These Terms apply to all users of the Services, including but not limited to consumers, account holders, and visitors to the website.
2. Eligibility
2.1 The Services are not intended for individuals under the age of 13. We do not knowingly collect or process personal data from children under 13. Use of the Services is recommended for users aged 17 and over.
2.2 By using the Services, you represent and warrant that you meet the eligibility requirements.

3.1 To use certain features of the Services, you must register for an account by providing accurate, current, and complete information.

5.1 All intellectual property rights in the Services, including all software, content, and design elements, are owned by or licensed to Your Phase Ltd. All rights are reserved.
5.2 You are granted a limited, non-exclusive, non-transferable licence to use the Services solely for your personal use in accordance with these Terms.
6. Privacy and Data Protection
6.1 Protecting your personal information is important to us. Our Privacy Policy, which is available at https://www.phaseapp.io/privacy, explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to it and how to contact us and supervisory authorities if you have a query or complaint.
6.2 Our website is hosted on Squarespace and uses their standard cookies and tracking technologies to provide essential functionality, analyze site usage, and support marketing efforts. By continuing to use our website and Services, you consent to the use of these technologies in accordance with our Cookie Policy, which is available at https://www.phaseapp.io/cookies.

ALWAYS CONSULT WITH YOUR HEALTHCARE PROFESSIONAL IF YOU HAVE ANY QUESTIONS OR CONCERNS ABOUT YOUR HEALTH OR CONDITION OR EXPERIENCE ANY CHANGES IN YOUR CONDITION OR HEALTH STATUS. IF YOU THINK YOU HAVE A MEDICAL EMERGENCY, CALL THE EMERGENCY SERVICES OR GO TO THE NEAREST OPEN EMERGENCY ROOM IMMEDIATELY.
The Services are intended solely to support general wellness and productivity and do not constitute medical advice, diagnosis, or treatment. The content provided through the Services is not intended to substitute for consultation with a qualified medical practitioner. You acknowledge that use of the Services does not establish a doctor–patient relationship. Any decisions relating to your health should be made in consultation with a licensed healthcare professional.
Furthermore, due to the variability of individual hormonal cycles and external factors, the Services must not be used for contraceptive purposes or relied upon to prevent pregnancy.
8. Limitation of Liability
8.1 Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be lawfully excluded.
8.2 Subject to clause 8.1, we shall not be liable for any indirect, incidental, special, or consequential loss or damage, or for any loss of profit, revenue, data, or goodwill arising out of or in connection with your use of the Services. For the avoidance of doubt, we expressly disclaim any liability for unintended pregnancy or any related reproductive health outcomes resulting from reliance on the Services for cycle tracking or contraception.
9. Failures of Networks or Hardware
9.1 The Services relies on a number of things working properly to enable you to enjoy all of its features. Many of these, such as your internet connection, your device and the Apple Store, Google Play or any other store where Phase is available (as applicable), are entirely outside of our control. Although we will do everything we reasonably can to resolve issues, we are not responsible to you if you are unable to use all or any part of the Services due to a poor internet connection, faulty components in your device (such as a faulty GPS signal, failing in the API with any suppliers of our Content or related features), Apple Store failure or failure of Google Play or other stores to function properly (as applicable) or anything else that it would not be reasonable to expect us to control.
10. Termination
10.1 We can end these Terms and our agreement with you for any reason and at our absolute discretion, including but not limited to if you do not comply with any part of them.
10.2 You may terminate your account at any time by contacting us at support@phaseapp.io. Upon termination, your right to use the Services will immediately cease. On termination, you can request for your data to be deleted (additional detail can be found in our privacy policy, https://www.phaseapp.io/privacy).
11. Subscription Terms
11.1 Subscription Services
The Services may offer features or content accessible only through a paid subscription (“Subscription”). Subscription plans may vary in pricing and functionality, and we reserve the right to modify or discontinue plans at our sole discretion. Any such changes will not affect your current Subscription until the end of your existing billing period.
11.2 Platform Provider
For subscriptions available via the Apple App Store, all billing, payments, cancellations, and refund requests are managed by Apple Inc., and are subject to the Apple Media Services Terms and Conditions. We do not collect or store payment information, nor do we process payments directly.
11.3 Automatic Renewal
Subscriptions purchased through the Apple App Store will automatically renew at the end of each billing cycle (monthly or annually, depending on the plan selected), unless overwise cancelled.
11.4 Cancellation
You may cancel your Subscription at any time through your Apple account settings. Instructions for managing your Subscription can be found at: https://support.apple.com/en-gb/HT202039. Cancellation will take effect at the end of the current billing cycle. Access to Subscription features will continue until the cancellation becomes effective.
11.5 Refunds
All purchases made through the iOS App Store are subject to Apple's terms and refund policies. To request a refund, please visit reportaproblem.apple.com and follow the instructions provided by Apple.We are unable to process refunds directly for purchases made through the App Store.
11.6 Trial Periods and Promotional Offers
We may offer introductory trials or promotional discounts from time to time. Unless cancelled before the end of the trial or promotional period, your Subscription will automatically convert to a paid Subscription and you will be charged in accordance with Section 11.3.
11.7 Changes to Pricing
We reserve the right to change the price of Subscriptions at any time. In the event of a price change, we will notify you at least one month in advance, and any increase will only take effect upon your renewal. Continued use of the Services following such notice constitutes your acceptance of the modified pricing.
12. Changes to These Terms
12.1 We may revise these Terms from time to time. Material changes will be notified to you, and your continued use of the Services following such changes constitutes your acceptance of the revised Terms.
13. Governing Law and Jurisdiction
13.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
13.2 Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
